andres GmbH strives to observe copyrights in the graphics, sound files, video sequences and texts used in all of its publications, or to use self-produced graphics, sound files, video sequences and texts or license-free graphics, sound files, video sequences and texts.
All protected brands and trademarks mentioned on the website and potentially by third-parties are unrestrictedly subject to the provisions of the relevant applicable trademark law and the proprietary rights of the relevant registered owner. The mere fact that brands are referred to by name should not lead to the conclusion that they are not protected by third-party rights!
The copyright for items published or created by andres GmbH itself is retained by the sites’ author. Duplication or use of such graphics, sound files, video sequences and texts in other electronic or printed publications is not permitted without express consent by andres GmbH.
All offers are subject to alteration and non-binding. andres GmbH expressly retains the right to amend, supplement or delete part or all of the website without giving notice. It may also temporarily or permanently cease publication.
Advice regarding problems with external links
As a content provider, in accordance with §5, para.1 of the German Teleservices Act of 22.07.1997 (TDG), andres GmbH is, in general legal terms, responsible for its “own content”, which it provides. Such own content does not include hyperlinks (“links”), to content held by other providers. By means of a hyperlink, andres GmbH provides “external content”, which is marked as follows: [Link] - whereby “link” stands for the name of the corresponding link. Furthermore, links may be contained in company logos, e.g. from publishers, seminar providers and partner companies, as well as in links via the URL of the links listed, as well as in other links that are recognisable as such. It is responsible for this external content only if it has positive knowledge of it (i.e. also from illegal or punishable content) and if it is technically possible and reasonable to prevent use of such (§ 5 Abs.2 TDG).
"Links" are always "living" (dynamic) references. andres GmbH has examined the external content at the time of the initial linkage as to whether it entails any responsibility in terms of civil or criminal law. However according to the TDG, we are not obliged to constantly check content to which it refers, for changes which would account for new liability. Only when we discover, or are informed by others, that a website to which we provide a link, may infringe civil or criminal law, will we remove the reference to this website, insofar as this is reasonable and technically possible. Technical feasibility and reason shall not be affected by the fact that such unlawful data or data liable to prosecution may be accessed from other servers even after the removal of the respective link from the andres GmbH homepage.
